Expansion and Reconstruction of Major Tailings Facility

This open-pit tailings facility had grown over decades to exceed its safe capacity as originally constructed and engineered. Called in to access contractual obligations of the contractor (a major United States design-construction firm) Walstad Law Group attorneys evaluate the design and construction performance of the constructor hired by the mine owner and determined a number of significant deficiencies arising from the constructor's own shortage of capital, as well as a pattern of concealment of those shortcomings from the owner. Our attorneys and staff developed an over-all owner strategy to correct the constructor's performance and hold them to compliance with the contract documents in force on the project. With the design-contractor's shortcomings identified, the project was brought back on track and completed with construction goals intact.
